TERMS OF USE

All of my Products/Designs are created at 300 ppi for optimum printing. All files are in .jpg and .png format and can be opened in many computer graphic programs used for scrapbooking & crafts,

including but not limited to: PhotoShop, Paint Shop Pro, Digital Image Pro, Picture It, PhotoShop Elements, and PhotoImpact.

The papers and all elements can be resized/cropped to fit your needs.

All elements can be altered as to color and size to fit your individual needs as long as these altered files are not resold or redistributed.

 
My files may NOT be shared, loaned, rented, resold individually or in a collection of any kind... this includes any files you have altered, or made into a template. You may

not offer this set for electronic download or include them in any graphics collection either on the internet or otherwise.

"Warning: The unauthorized reproduction or distribution of this copyrighted work is illegal. Criminal copyright infringement, including infringement without monetary gain, is investigated by the FBI and is punishable by up to 5 years in federal prison and a fine of $250,000."

GENERAL CONDITIONS OF USE:

My Products/Designs are copyright © Shelle Pukas/Designs by Shelle 2004 - 2008, with all rights reserved, unless otherwise stated. The purchase of my Product/Design offers you the "right to use"; the ownership and copyright remains with the Designer. Any other use is a violation of copyright laws. Please Note that you do not own the individual graphics/artwork, but you have purchased the rights to use them as outlined in this Terms of Use Document. The Designer/Creator, Shelle Pukas, retains all other rights.

 
YOU HAVE THE RIGHT:

~To install and use the Designs on your personal computer.

~To copy and alter the Designs for your own personal use.

~To use the Designs in Layouts submitted for publications.*

YOU DO NOT HAVE THE RIGHT:

To share, loan, rent, resell or distribute the original or altered Designs as a set or individually.  This includes creating brushes and tubes. Files sharing is illegal and violators will be prosecuted.  File sharing in groups is illegal.

 
To offer these Designs in electronic download or to include them in any graphic collection either on the Internet or otherwise.

 
To make copies of the Designs other than for back-up purposes.

 To make templates of any kind. This includes templates for Incredimail or other similar programs.  This is considered digital distribution and is not permitted.

PERSONAL USE:

This limited “right” allows you to use my graphics to create items for your personal use. You can also use these graphics to create handmade tangible items to give to others as gifts.

The following conditions are in addition to the General Conditions specified.

SCRAP-FOR-HIRE – Home-based Individual digital scrapbooking artists that produce hard copy scrapbook pages for individual clients.

You may use my Products/Designs in the preparation of a hard copy digital scrapbook for  your client.  (Flattened, printed Version)

 
You may provide a Preview to your client in digital format so long as it's flattened and not able to be used as a template.

PROFESSIONAL CRAFTERS – Individuals who produce tangible crafts and products that are sold to others.

You may use my Products/Designs in the preparation of your crafts.

Any given Product/Design can be used to create handmade, tangible craft items which are sold directly to the public. For example, you can produce candy bar wrappers, greeting cards, paint cans, lamp shades, glass blocks, t-shirts, quilt squares, jar labels, recipe cards, note cards, stationery sets, window clings, magnets, wall hangings, decoupage wood items, indoor/outdoor signs, gift bags, gift boxes, etc. Digital templates of these are NOT permitted.

Your handmade crafts can be sold at craft fairs, and other venues, including online websites as long as you follow the guidelines produced in this TOU.

You may not sell more than 200 items per calendar year using the same Product/Design.

Professional Photographers, Web & Blog Designers and Hardcover Coffee Table Book Producers or any other commercial use – please contact me.

Limited Warranty:

Shelle Pukas/Designs by Shelle warrants that your purchase shall be free of defects for a  period of 30 days commencing on the date of purchase. If defects are found, you must notify me by email at the location your product was purchased from.

The only remedy for defects is replacement of the Product/Designs found to be defective.

Shelle Pukas/Designs by Shelle have taken due diligence to assure that all of the files are in good working order, defect-free and virus-free, however, users assume their own risk.
